A recent request for a shortfall payment by Hancock Bank to Madison County supervisors over the failed Parkway East Public Improvement District was a mere formality, Board Attorney Katie Bryant Snell told supervisors last week.

“They have to bill us under the indenture agreement…before they can make a claim,” Snell said. “We’ll probably continue to receive requests. In fact, we will.”

Assured Guaranty insured the original bonds and up until this year was embroiled in litigation with the county over the county’s continued obligation to make shortfall payments for the PID. 

Assured and the county ultimately reached a settlement agreement in March. 

In order for Hancock to collect money from Assured to pay any shortfall amounts, the trustee must make requests for money from the county and PID.
